This Privacy Policy explains how 49 Native Design Inc. ("49Dzine", "we", "us" or "our") collects, uses, shares and protects personal information when you visit 49dzine.com, buy from us online, contact us, or sign up for our emails or texts.

We are based in Calgary, Alberta, Canada, and we sell to customers in Canada (excluding Quebec) and the United States. This policy does not cover purchases made in our retail store, which are handled through a separate system.

1. Information we collect

Information you give us

  • Contact and order details: your name, email address, phone number, billing address, shipping address and the items you order.
  • Account details: if you create an account, your login details and order history.
  • Payment details: payments are processed by Shopify and its payment partners. We do not see or store your full card number.
  • Messages: what you send us by email, live chat, social media or our contact form, including return and exchange requests.
  • Marketing preferences: whether you have agreed to receive marketing emails or text messages.
  • Reviews and content: reviews, photos or other content you choose to share with us.

Information collected automatically

When you visit our website or open our emails, we and our service providers collect information such as your IP address, device and browser type, pages viewed, products added to your cart, how you arrived at our site, and whether you opened or clicked an email. We collect this using cookies, pixels and similar technologies (see section 6).

Information from others

We may receive information from Shopify, payment processors, shipping carriers and tracking services (such as delivery status), fraud-prevention services, and social media platforms when you interact with our accounts or ads.

2. How we use your information

  • To process and deliver your order, including sharing your details with the manufacturing partners who make your items and the carriers who deliver them.
  • To send order, shipping, tracking and delivery updates.
  • To handle returns, exchanges, refunds and customer service.
  • To send marketing emails and text messages, but only if you have agreed to receive them.
  • To show you relevant ads on other websites and social media, and to measure how well our ads work.
  • To understand how people use our website so we can improve it.
  • To detect and prevent fraud and protect our store and customers.
  • To meet our legal, tax and accounting obligations.

3. Consent

When you place an order or contact us, you consent to us using your information for that purpose. We ask for your express consent before sending you marketing emails or texts. You can withdraw your consent at any time. Use the unsubscribe link in any marketing email, reply STOP to any marketing text, or email us at hello@49design.com. Withdrawing marketing consent does not stop order-related messages.

4. Who we share your information with

We share personal information only as needed for the purposes above, with:

  • Shopify, which hosts our store, processes payments and stores our customer data.
  • Manufacturing and fulfillment partners who make and ship our products. Most of our products are made to order by partners located in Canada, the United States, China and other countries, who receive the name, shipping address and order details needed to make and ship your items.
  • Shipping carriers and tracking services that deliver your order and provide tracking updates.
  • Marketing and advertising services, including our email and text message providers and advertising platforms such as Meta (Facebook and Instagram) and Google.
  • Customer service tools, such as our live chat and help desk software.
  • Analytics, fraud-prevention and website tools that help us run and secure our store, including tools that help our staff manage orders and store content, some of which use artificial intelligence.
  • Professional advisers, such as accountants and lawyers.
  • Authorities, when required by law, or to protect our rights, customers or business.
  • A buyer or successor, if our business is sold or merged.

We require our service providers to use personal information only to provide services to us, except where they use it under their own privacy policies (for example, advertising platforms).

5. Advertising, "sales" and "sharing" under U.S. state laws

We use advertising tools, including Shopify Audiences and Shopify's network intelligence features, Meta and Google, that use information about your visits and purchases to show you more relevant ads. Under some U.S. state privacy laws, this may be considered a "sale" or "sharing" of personal information, or "targeted advertising." We do not sell your information for money.

Depending on where you live, you can opt out on our Your Privacy Choices page. If your browser sends a Global Privacy Control signal, we treat it as an opt-out request for that browser, where required by law. You can also limit personalized ads from Shopify merchants at privacy.shopify.com.

6. Cookies and similar technologies

We use cookies and similar technologies to keep our store working (for example, remembering your cart), to understand how our site is used, and for advertising. For details about the cookies Shopify uses, see Shopify's cookie policy.

You can block or delete cookies in your browser settings, although parts of our store may not work properly. You can also manage ad preferences through Meta, Google, or youradchoices.ca (Canada) and optout.aboutads.info (U.S.).

7. Where your information is stored and processed

Our customer data is stored by Shopify in the United States. Because our manufacturing partners, shipping carriers and service providers are located in several countries, including Canada, the United States and China, your information may be transferred to, stored in and processed in those countries. The laws there may differ from the laws where you live, and authorities there may be able to access your information under their laws.

8. How long we keep your information

  • Order and transaction records: for as long as required by tax and accounting laws, generally at least six years after the end of the tax year of the purchase.
  • Customer accounts: until you ask us to delete your account, unless we need to keep certain records for legal reasons.
  • Marketing contact details: until you unsubscribe, after which we keep only what we need to respect your choice.
  • Customer service messages: about 12 months.
  • Notes attached to your orders (for example, details from a return or customer service request): for as long as you have an account with us or, for orders placed without an account, for as long as we keep the order record.

9. How we protect your information

We use reasonable administrative, technical and physical safeguards to protect personal information, and we limit access to people and service providers who need it. No method of transmission or storage is completely secure, so we cannot guarantee absolute security. Please do not send sensitive information, such as full card numbers, by email or chat.

10. Your rights

Canada: you can ask to access the personal information we hold about you, ask us to correct it, and withdraw your consent to certain uses. You can also ask us to delete information we no longer need.

United States: depending on your state, you may have the right to know what personal information we collect, to access it, correct it, delete it, receive a copy, opt out of targeted advertising, "sales" or "sharing," and appeal a decision we make about your request.

To make a request, email hello@49design.com or our Privacy Officer (see section 14). We may need to verify your identity before responding, and you may use an authorized agent where the law allows. We will not treat you differently for exercising your privacy rights. If we deny your request, you can appeal by replying to our response.

11. Children

Our website is not directed to children under 13, and we do not knowingly collect personal information from them. We do not knowingly sell or share the personal information of anyone under 16. If you believe a child has given us personal information, please contact us and we will delete it.

12. Other websites

Our site may link to other websites and social media platforms. Their privacy practices are governed by their own policies, not this one.

13. Changes to this policy

We may update this policy from time to time. We will post the updated version on this page and change the "Last updated" date. If we make significant changes, we will let you know where required by law.

14. Contact us and complaints

Our Privacy Officer is responsible for how we handle personal information. You can contact them directly with any questions, requests or complaints about your privacy.
